Terms and Conditions for LookSee

1. Agreement to These Terms

These Terms and Conditions (the “Terms”) are a binding agreement between you and Information Outpost, LLC (“Information Outpost,” “we,” “us,” or “our”) governing your access to and use of the LookSee mobile application, related websites, software, content, features, and services (collectively, the “Service”). By downloading, accessing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.

LookSee is intended for a general audience, including children. A child may use the Service only with the involvement, permission, and supervision of a parent or legal guardian where required by law. If you are a parent or guardian who allows a child to use LookSee, you accept these Terms on the child’s behalf, are responsible for the child’s activity, and must review proposed uploads and purchases. Users must not provide false age information or bypass age-assurance, parental-consent, parental-gate, or family-control features. We may restrict features, data collection, advertising, communications, uploads, or purchases based on age or an unknown-age status.

2. Accounts, Usernames, and Passwords

·        You may need to create an account using accurate, current, and complete information.

·        You are responsible for maintaining the confidentiality of your username, password, and other credentials and for all activity occurring under your account.

·        You must use a strong, unique password and promptly notify us at looksee.support@informationoutpost.com if you suspect unauthorized access, loss of credentials, or another security incident.

·        You may not impersonate another person, use credentials you are not authorized to use, sell or transfer your account, or allow another person to access the Service in violation of these Terms.

·        We may require you to change credentials, verify account information, or suspend access when reasonably necessary to protect the Service, users, or third parties.

3. Limited License and Acceptable Use

Subject to these Terms, Information Outpost grants you a limited, personal, revocable, nonexclusive, nontransferable, and nonsublicensable license to install and use LookSee on devices you own or control solely for lawful, personal purposes. You may not:

·        copy, modify, distribute, sell, rent, lease, sublicense, reverse engineer, decompile, disassemble, or attempt to derive source code from the Service except where applicable law expressly permits it;

·        circumvent security, access controls, usage limits, or technological protections;

·        introduce malware, interfere with operation of the Service, overload systems, scrape or harvest data, or use automated means without our written permission;

·        use the Service to violate law, infringe rights, harass others, commit fraud, or transmit unlawful, deceptive, harmful, or objectionable material; or

·        use the Service or its output to build or train a competing product except with our written permission.

4. User Content and Feedback

4.1 User Content Ownership and License

You retain all ownership rights in any text, images, videos, audio, or other materials you upload, post, or otherwise make available through the Service ("User Content"). However, by uploading or sharing User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform that User Content in connection with the operation, promotion, and improvement of the Service.

4.2 Prohibited Content and Conduct

You are solely responsible for your User Content. You represent that you have all necessary rights and permissions for your User Content. You agree that you will not post, upload, or transmit any User Content that:

4.3 Zero-Tolerance for Abusive Content and User-Blocking Clause

We enforce a strict zero-tolerance policy toward abusive, harassing, illegal, harmful, or objectionable content and behavior.

4.4 Digital Millennium Copyright Act (DMCA) Policy

We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using the Service that are reported to us.

If you are a copyright owner or authorized to act on behalf of one, please report alleged copyright infringements taking place on or through the Service by completing a DMCA Notice of Alleged Infringement and delivering it to our Designated Agent. You may also use our in-app red flag reporting option available on landmarks clicked on from our map. Upon receipt of the Notice, we will take whatever action, in our sole discretion, we deem appropriate, including removal of the challenged material from the Service.

4.5 User Content Review

We may use automated tools and human review to screen content and may reject, quarantine, remove, delete, disable access to, or preserve User Content when we reasonably believe it is unsafe, inappropriate, unlawful, infringing, contrary to these Terms or store policies, or necessary to protect users. Users may report inappropriate content or conduct through our in-app red flag reporting option available on landmarks clicked on from our map or by emailing looksee.support@informationoutpost.com. We may act on reports and cooperate with lawful requests, but we do not guarantee that all content will be reviewed before it appears. Any feedback or suggestions may be used without restriction or compensation.

5. Third-Party Advertising and Services

The Service may display advertisements, sponsored content, offers, links, software development kits, or services supplied by third parties, including Google AdMob. Because LookSee is intended for all audiences, including children, we will configure child or unknown-age ad requests for age-restricted treatment, use only advertising SDKs and formats permitted for the relevant audience, apply an age-appropriate maximum ad-content rating, and serve only ads eligible for children and families where required. Personalized or interest-based advertising, remarketing, and transmission of advertising identifiers, if used, will be disabled for children and users whose age is unknown where required by law or platform policy. We will not intentionally use sensitive personal information from children for advertising.

For users legally eligible for personalized advertising, we will request any required permission before enabling it. Advertising choices may be available through LookSee settings, device settings, consent tools, or advertising-partner controls; disabling personalization may not eliminate ads. Ads will be identified and presented so they are distinguishable from app content, and we will not knowingly use deceptive placements or pressure children to make purchases. Third-party advertisers and service providers are independent from Information Outpost. We do not control or endorse their content, products, privacy practices, availability, or security. Parents and guardians should supervise a child’s interaction with any advertisement or external service.

6. Privacy and Data Security

Our Privacy Policy, available at Privacy Policy, explains the categories of personal information collected, the purposes and legal bases for processing, retention, disclosures to service providers and advertising partners, security practices, and user choices. It will also describe payment information and transaction data processed by Stripe and the information Stripe returns to Information Outpost. For children, we will limit collection to information reasonably necessary to provide the Service, avoid conditioning participation on disclosure of more information than necessary, provide direct notice to parents or guardians, and obtain verifiable parental consent when required before collecting, using, or disclosing a child’s personal information. A verified parent or guardian may contact looksee.support@informationoutpost.com to request access to, correction or deletion of a child’s information, revoke consent, or prevent further collection. We may take reasonable steps to verify the requester’s identity and authority. Although we use reasonable safeguards, no system or transmission method is completely secure.

7. App Stores, Devices, and Updates

If you obtained LookSee through Apple’s App Store, you acknowledge that these Terms are between you and Information Outpost, not Apple; Information Outpost, not Apple, is responsible for LookSee, its content, maintenance, support, warranties, product claims, and intellectual property claims. Your license is limited to use on Apple-branded products you own or control as permitted by Apple’s usage rules, including Family Sharing where allowed. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable app-license provisions. If LookSee fails to conform to an applicable warranty, you may notify Apple and Apple may refund the app purchase price, if any; to the maximum extent permitted by law, Apple has no further warranty obligation. If you obtained LookSee through Google Play, your use remains subject to Google Play’s terms, policies, family controls, and distribution requirements. Purchases described in Section 8 are processed by Stripe, not by Apple or Google, but only where that payment method is permitted for the applicable storefront, country, program, product, and distribution method. We may require a different checkout method, disable purchasing, or direct you to an external checkout page where necessary to comply with platform rules or law. You are responsible for compatible hardware, software, connectivity, carrier charges, and updates.

8. Subscriptions, Tokens, Billing, and Refunds

LookSee may offer free features, auto-renewing subscriptions, and one-time purchases of virtual credits called “Tokens.” Before purchase, the Stripe checkout page will display the product, price, billing period, taxes, included features or Token quantity, and any trial or promotional terms. Subscriptions provide ongoing access to the benefits described at purchase and automatically renew for the same period unless canceled before the renewal date shown in your account or checkout disclosures. By starting a subscription, you authorize Information Outpost and Stripe to charge the selected payment method for the initial term and each renewal, including applicable taxes, until canceled. You may manage or cancel a subscription through the LookSee account or by contacting looksee.support@informationoutpost.com. Cancellation takes effect at the end of the current paid period unless applicable law requires otherwise. Deleting LookSee or your account does not itself cancel a subscription.

Tokens are a limited, personal, revocable license to access designated in-app processing or upload services, including submission of data for AI model training. Tokens are not money or cryptocurrency, have no cash value, do not earn interest, and may not be sold, transferred, redeemed for cash, or used outside LookSee. Unless the purchase screen states otherwise, Tokens are consumed when an upload or training job is accepted for processing; failed or canceled jobs may be restored at our discretion or where required by law. Token balances may be subject to reasonable limits and expire only if clearly disclosed before purchase or required by law. Purchases by a child must be initiated and authorized by a parent or legal guardian using applicable parental gates or controls. Prices and subscription benefits may change prospectively with notice required by law.

Information Outpost uses Stripe as its third-party payment processor. When you make a purchase, Stripe may collect and process payment-card details, billing information, device and transaction data, and other information needed to authorize, complete, secure, and document the transaction. Information Outpost generally does not receive your full payment-card number. Stripe’s processing is governed by its own terms and privacy notice, and you authorize Information Outpost and Stripe to share transaction information as necessary for payment processing, fraud prevention, tax, receipts, customer support, refunds, chargebacks, and legal compliance. You must provide accurate billing information and are responsible for charges authorized through your account. Receipts may be sent electronically.

Except as required by applicable law or expressly stated at checkout, subscription and Token purchases are final and nonrefundable. Refund requests and billing questions must be sent to looksee.support@informationoutpost.com. We may issue refunds or credits in our discretion, without creating an obligation to do so in similar cases. If a payment fails, is reversed, or is disputed, we may suspend subscription benefits, withhold or remove unconsumed Tokens, recover amounts owed, or cancel the transaction. You agree to contact us before initiating a chargeback so we have a reasonable opportunity to address the issue. Nothing in this paragraph limits rights that cannot lawfully be waived. Stripe checkout is offered only where permitted by applicable Apple, Google, Stripe, and legal requirements; platform fees, reporting duties, disclosures, or alternate billing methods may still apply even though Stripe processes the payment.

9. AI Model Training Data and Outputs

You may use Tokens to upload datasets, images, text, audio, video, labels, model files, or other materials for AI model training or related processing (“Training Data”). You must own the Training Data or have all permissions, licenses, notices, and consents required for Information Outpost and its processors to use it for the requested service. Do not upload material that violates the all-ages content rules or contains confidential information, biometric identifiers, health information, precise location, government identifiers, financial credentials, authentication secrets, or personal information of another person unless the feature expressly permits it and you have a lawful basis and all required consent. Training Data concerning a child may be uploaded only by, or with verified authorization from, the child’s parent or legal guardian and only when permitted by law and the applicable store policies.

You grant Information Outpost and its disclosed service providers a limited, worldwide, nonexclusive license to store, copy, transmit, format, analyze, and otherwise process Training Data solely to perform the requested upload, training, evaluation, security, support, and legal-compliance functions, unless you separately and affirmatively agree to broader use. Information Outpost will not use a child’s Training Data to train a general-purpose or shared model or for advertising. The Privacy Policy will identify relevant providers, retention periods, deletion methods, and whether trained models or outputs can be deleted after Tokens are consumed. AI results may be incomplete, inaccurate, biased, or unsuitable for a particular purpose; you must review outputs before relying on them. You are responsible for lawful use of trained models and outputs, and no ownership of third-party material is transferred to you.

10. Ownership and Intellectual Property

The Service, including its software, design, text, graphics, interfaces, databases, trademarks, logos, and other content excluding User Content, is owned by or licensed to Information Outpost and is protected by intellectual property laws. No right, title, or interest is transferred to you except for the limited license expressly granted in these Terms. “Information Outpost,” “LookSee,” and associated names and marks may not be used without prior written permission.

11. Service Availability and Changes

We may add, modify, suspend, or discontinue any part of the Service at any time, including features, content, or advertising arrangements. We do not guarantee uninterrupted, timely, secure, or error-free operation, compatibility with every device, or continued availability of any feature. We may conduct maintenance or restrict access to protect users, systems, or legal interests.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THIRD-PARTY ADVERTISEMENTS, PRODUCTS, SERVICES, OR CONTENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO PORTIONS OF THIS SECTION MAY NOT APPLY TO YOU.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INFORMATION OUTPOST AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, USE, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE, ADVERTISEMENTS, THIRD-PARTY SERVICES, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID INFORMATION OUTPOST FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US $100. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW OR TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Information Outpost and its members, managers, employees, contractors, licensors, and service providers from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising from your User Content, misuse of the Service, violation of these Terms, violation of law, or infringement of another person’s rights. We may assume control of the defense of any covered matter, and you agree to cooperate.

15. Suspension, Termination, and Account Deletion

You may stop using the Service at any time and may request account deletion through any available in-app method or by emailing looksee.support@informationoutpost.com. We may suspend or terminate access, with or without notice, if we reasonably believe you violated these Terms, created risk or legal exposure, engaged in fraud or abuse, or if suspension is needed for security, operational, or legal reasons. Upon termination, your license ends and you must stop using the Service. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, indemnification, dispute terms, and general provisions—will survive. Account deletion and data retention are subject to our Privacy Policy and legal obligations.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-laws principles. Before filing a claim, you and Information Outpost agree to attempt in good faith to resolve the dispute by sending written notice describing the claim and requested relief to the contact address below and allowing 30 days for a response. Unless applicable law requires otherwise, any unresolved dispute will be brought exclusively in the state courts located in New London County, Connecticut, or the federal courts having jurisdiction over New London County, Connecticut, and each party consents to personal jurisdiction and venue there. This section does not prevent either party from seeking injunctive relief or bringing an eligible claim in small-claims court. Nothing in these Terms limits non-waivable consumer rights in your jurisdiction.

17. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms and update the “Last Updated” date. If changes are material, we will provide additional notice as required by law, such as an in-app notice or account communication. Changes become effective on the stated date. Your continued use after the effective date constitutes acceptance, except where affirmative consent is required. If you do not agree to revised Terms, you must stop using the Service.

18. General Provisions

You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, reorganization, asset transfer, or by operation of law. A failure to enforce a provision is not a waiver. If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder will remain effective. These Terms and the Privacy Policy constitute the entire agreement between you and Information Outpost concerning the Service and supersede prior agreements on that subject. Headings are for convenience only. You must comply with applicable export controls, sanctions, and other laws when using the Service.
